Privacy Policy

Thank you for visiting Visbl.com, which is owned and operated by Visbl, Inc. and its affiliates (collectively, Visbl” or “we” or “us”).  This Privacy Policy describes the personal information handling policies of Visbl in connection with its technology platform available at www.visbl.com (the “Platform”).  The Platform is limited to match-making and evaluation tools to enable website visitors (“Visitors”) and mortgage shoppers (“Shoppers”) to quickly evaluate certain financial aspects of available mortgage loans and related offers based on information supplied by lenders and loan specialists.   

While the Platform is available for access and use by lenders and loan specialists, such use by lenders and loan specialists is by and through individuals operating in their professional capacity (and not as consumers).  Accordingly, except as otherwise described herein, this Privacy Policy is limited to the information Visbl collects from Visitors and Shoppers acting in their consumer or household capacity.  This Privacy Policy is divided into the following sections: 

1. What personal information we collect from the provision of products and services available through the Platform (collectively, the “Services”);

1. Personal Information We Collect or Process 

(a) The Services capture some information about our Visitors and Shoppers (or “you”) automatically utilizing background local storage and session storage technologies (“Cookies”). Cookies are small files or other pieces of data which are downloaded or stored on your computer or other device, that can be tied to information about your use of the Platform. Examples of information of this type are your IP address, the browser you are using, the operating system you are using, the pages on the Platform that you visit and details of your activity.  When we use Cookies, we may use “session” Cookies that last until you close your browser or “persistent” Cookies that last until you or your browser delete them. You may change your browser setting to decline the use of Cookies.  

We use Google Analytics, which uses Cookies to identify the frequency of use of certain areas of our Platform and to identify preferences. For more information regarding how Google collects, uses and shares your information please visit http://www.google.com/policies/privacy/partners/. Google will use this information to analyze your use of the Services, compile reports on activity for us, and perform further services associated with website use and Internet use. We may use third-party companies to help us tailor website content to users or to serve ads or messages on our behalf. These companies may employ Cookies and web beacons to measure advertising or messaging effectiveness (such as which web pages are visited, which messages are responded to, or what products are purchased and in what amount). Any information that these third parties collect via Cookies and web beacons is not linked (by them) to any personal information collected by us. 

We may operate social media pages on third party networks and have social media icons on our Platform. When you visit or link to our social media pages, data is processed both by us and the applicable social media provider. Social media providers are unaffiliated with us, and we are not responsible for the content or privacy practices of social media providers.  Social media providers have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms. 

 

(b) We also collect information that you provide to us voluntarily.   

We collect the information that you provide to us when you sign up to receive newsletters, advisories, announcements and invitations and contact us by email, phone or chat. We may record our interactions with you and use third party service providers to record and store transcripts of conversations and chats. We may now or in the future utilize a “bot” in our chat feature.  

Visitors are able to browse our Platform, enter search criteria (e.g., purchase price, estimated credit score, postal code, down payment percentage and loan amount) and view results that match the criteria (including rates, fees and reviews) without providing any contact or financial information.  

If Visitors want to save searches, save results, save vendor profiles (such as loan officers), and view search history, they can create a personal profile account by entering their name, email and phone number, and creating a login and password. Visitors that create a profile are hereinafter referred to as “Shoppers.” Information saved in the personal profile account will auto-populate if the Shopper chooses to complete a mortgage application (described below).  

Shoppers can complete a mortgage industry standard loan application on the Platform. The application will include fields for name, address, phone, email, birth date, citizenship, marital status, employer, position, income, assets, and demographic information. In addition, Shoppers can upload income and asset information which will be needed for the mortgage seller to ultimately provide the product. Uploaded documents may include, without limitation, a copy of driver’s license or passport, tax returns, W-2’s 1099’s, recent paystubs, bank statements and retirement account statements. Such documents will reside on a server controlled by Visbl until the recipient of the mortgage application that you select retrieves the information.  Visbl uses administrative and technological tools to prevent any Visbl personnel from viewing the documents in furtherance of data minimization principles. 

 

(c) We do not knowingly collect information from users of our Platform under the age of 18 and/or their internet usage, and such persons are not authorized to use the Services. If we obtain actual knowledge that a user is under 18, we will take steps to remove that user’s personal information from our databases. By using the Services, you represent that you are at least 18 years old and of legal age to enter into legal agreements. 

 

2. How We Use the Information 

We use information about you for the following purposes, as permitted by applicable law:   

  • For general business purposes, including managing your account and relationship with us, responding to enquiries and requests, and administrative purposes. 
  • To complete services requested by you.  
  • To manage and assure the integrity of the Platform. 
  • To communicate with you, including to provide status updates, transactional emails and other service communications, to provide you with notices about your account and to contact you through telephone, text, email or chat, as permitted by law. 
  • To send you marketing communications. 
  • To communicate with you for research purposes, including to request your participation in surveys. 
  • To provide, maintain, and protect our Services. 
  • To deliver advertisements. 
  • To monitor the performance of our Services and improve your user experience. 
  • To satisfy legal obligations and compliance requirements under laws and regulations applicable to us.  
  • To protect and defend the rights and property of our users, Visbl, and third parties.  
  • To comply with legal obligations and regulations to which Visbl is subject and cooperate with regulators, other appropriate agencies or authorities and law enforcement bodies, both within your jurisdiction and internationally. 
  • To develop, improve and test certain of our products and services. 
  • For other purposes that we tell you about when you register or provide information about yourself to us. 
  • For other legitimate business and lawful purposes. 

We may use the phone number of users who create a profile for dual authentication purposes and as described in Section 4 below. 

We may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Services, including for any other contemplated uses of your personal information not addressed in this Privacy Policy. Please read all online agreements carefully before accepting them.  

 

3. With Whom We Share Personal Information 

We may share your personal information with our affiliates and third parties who perform services on our behalf, including without limitation our technology providers and developers, communications providers, and professional advisors.   

The information described in Section 1(b) above will be shared with the information content providers and thirdparty vendors (such as escrow agents and title companies) involved with providing the product chosen by the Shopper from our Platform.  Information content providers include loan officers, brokers and lenders.  If the Shopper wishes to complete a mortgage application, the Shopper will need to create a profile, complete a mortgage application, upload supporting documentation, and click to share their profile, application, and supporting documents, and the information will be shared with the selected content providers and third party vendors.  Information content providers and third-party vendors are unaffiliated with us, and we are not responsible for the content or privacy practices of the information content providers and third-party vendors. Information content providers and third-party vendors have their own terms of use and privacy policies, and we encourage you to review those policies before selecting them through the Platform and whenever you interact with them.  

If you opt-in to mobile messaging, we will use information you provide to transmit your mobile messages and respond to you, if necessary. This includes sharing information with platform providers, phone companies, and other third-party service providers who assist us in the delivery of mobile messages.  As with all information collected by us, we reserve the right at all times, to the extent permitted by law, to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. 

We have relationships with third parties, including ___________________. We may provide them some personal information such as your name and email so that they may contact you about products or promotions you may be interested in. 

We may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Services, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, or the rights or property of visitors to or users of the Services. Client reserves the right at all times to disclose any information that we deem necessary to comply with any applicable law, regulation, legal process or governmental request. We may disclose your information when we determine that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes. 

We may share your information with a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party.  

We may share aggregated and de-identified information with third parties for analytical, research or other similar purposes.  

 

4. Mobile Messaging 

For purposes of this Section 4 (and other provisions in this Privacy Policy addressing use of mobile number), “you” and “your” includes the loan specialists and representatives of brokers and lenders to the extent such individuals submit a personal mobile phone number at the creation of a profile.  

 

We use your mobile number for authentication purposes. We may send you service-related announcements when it is necessary (for example, if we must temporarily suspend our service for maintenance). Also, you may choose to receive promotional texts from us based on preferences that you indicate. We may offer mobile messaging, where, if you opt-in, you agree to this Privacy Policy and to receive text messages from us. Participation in mobile messaging is optional and not a condition of purchase. The messages we send to you may include marketing messages and service-related communications. Messaging frequency may vary. You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions. 

 

Regardless of the opt-in method you utilized to participate in mobile messaging, you agree that this Privacy Policy applies to your participation in mobile messaging. By participating in mobile messaging, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”). Message and data rates may apply. Please consult your mobile service carrier’s pricing plan to determine the charges for browsing data and sending and receiving mobile messages. Under no circumstances will we be responsible for any messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number. 

SMS/MMS MOBILE MESSAGING OPT-OUT: If you do not wish to continue to receive mobile messages, please reply STOP to any mobile message from us in order to opt out. You may receive an additional mobile message confirming your decision to opt out. 

 

5. Storage and Protection of Your Personal Information 

We retain the personal information we collect for so long as reasonably necessary to fulfill the purposes for which the information was collected and to perform our contractual and legal obligations. We will retain personal information required to comply with privacy requests, to manage active accounts, as required by law, in order to resolve disputes, or to enforce our agreements. We will retain the personal information processed on behalf of our users as directed by them. We may also retain copies of your personal information for disaster recovery purposes, to prevent fraud or future abuse, or for other legitimate business purposes. 

Notwithstanding the generality of the foregoing, we store email addresses until the user requests to be unsubscribed or removes themselves through any self-service tools offered to the user.   

We take reasonable administrative, physical and technical precautions to protect your personal information and communications between us.  This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to your information that they will protect the information with reasonable safeguards.   

No Internet or e-mail transmission is ever fully secure or error free, however.  We therefore cannot guarantee absolute security of your information, and we are not responsible for processes and networks that we do not control.  Users assume the risk of security breaches and the consequences resulting from them.  Please be careful in deciding what information you send to us via email or over the Internet.   

 

6. Your Rights, Choices and Disclosures 

We are committed to facilitating the exercise of your rights granted by the laws of your jurisdiction, which may include the right to request the correction, modification or deletion of your personal information and the right to opt out of the sale or sharing of your personal information (as applicable). We will do our best to honor your requests subject to any legal and contractual obligations.  If you would like to make a request, cancel your account or request we delete or no longer use your account information to provide you Services, contact us at support@visbl.com or make changes to any user profile information connected to your profile 

You may opt out of receiving electronic marketing communications from us by clicking on the “unsubscribe” link on the communication or contacting us at support@visbl.com. Some non-marketing communications may not be subject to a general opt-out, such as communications about transactions, disclosures to comply with legal requirements, software updates and other support-related information.  If you do not wish to receive any service-related emails from us, you have the option to deactivate your account. 

Subject to local law, you may have additional rights under the laws of your jurisdiction regarding your personal information, such as the right to complain to your local data protection authority and the right to appeal our decision regarding a data access request  

You may be able to disable Cookies through your browser settings, but if you delete or disable Cookies, you may experience interruptions or limited functionality in certain areas of the Services.   

California “Shine the Light” Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed.  If you are a California resident and want such a list, please send us a written request by email to support@visbl.com with “California Shine The Light Rights” in the subject line.   

California Do Not Track Disclosure: We do not respond to Do Not Track browser settings at this time.   

California Consumer Privacy Act. At this time, Visbl is not a “business” subject to the California Consumer Privacy Act.  

 

7. Users Outside the United States 

Visbl and the Services are controlled and operated from the United States. We do not market our products and services outside the United States. If you are an individual from the European Union, Canada or any other jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that we may store the information we collect in the United States which is not deemed an “adequate jurisdiction” by the European regulatory authorities.  Personal information may also be transferred from the country of your residence to other countries, including the United StatesBy visiting or using our Services, you are consenting to the transfer of your information from your jurisdiction to the United States. 

 

8. Third Party Links 

Certain features of our Services contain links to other websites and online services. If you choose to visit a third-party service or an advertiser by clicking a banner ad or other type of advertisement, or click on another third-party link, you will be directed to that third-party’s website or online service. The fact that we provide a link to a website’s content or present a banner ad or other type of advertisement is not an endorsement, authorization, or representation of our affiliation with that third-party, nor is it an endorsement of their privacy or information security policies or practices. This Privacy Policy is not applicable to the websites or content of any such third parties. We do not exercise control over third-party websites or services. These other websites or services may place their own cookies or other files on your computer, collect information or solicit personal information from you. Other websites and services follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of any such third-party websites and services that you may use. 

 

9. Privacy Policy Changes 

We may update this Privacy Policy from time to time and without prior notice to you to reflect changes in our information practices, and any such amendments shall apply to information already collected and to be collected. Your continued use of the Services after any changes to our Privacy Policy indicates your agreement with the terms of the revised Privacy Policy.  Please review this Privacy Policy periodically and especially before you provide personal information to us.  We will post a notice on our Platform to notify you of any material changes to our Privacy Policy and indicate at the top of the policy when it was most recently updated. We will also communicate changes as required by applicable law.
